This Content Provider Agreement (the "Agreement") is entered into between OnlyDrain Entertainment LLC, operating the website PayPig Central at paypigcentral.com (the "Platform," "we," "us"), and you, the individual uploading, streaming, or otherwise providing content to the Platform (the "Content Provider," "you").
By checking the box affirming your agreement, you enter into a binding agreement with the Platform. You may not upload, stream, or publish any content on the Platform unless you have accepted this Agreement.
1.1 You represent and warrant that you are at least eighteen (18) years of age, and that you have completed the Platform's government-issued photo identification verification process.
1.2 You represent and warrant that you have the full legal right, power, and authority to enter into this Agreement and to grant the rights described in it.
2.1 You shall not upload, stream, publish, transmit, or otherwise provide any content that is illegal or that violates the Payment Card Industry standards, the rules of Visa, Mastercard, or any other card network, the rules of our payment processor, or this Agreement (collectively, the "Standards").
2.2 Without limiting Section 2.1, the following content is strictly prohibited:
2.3 You shall not use the Platform's messaging, profile, payment, or live video features to arrange, solicit, advertise, or facilitate any of the conduct prohibited in Section 2.2.
2.4 This list is not exhaustive. The Platform may prohibit additional categories of content at any time, and you are responsible for complying with the current version of this Agreement.
3.1 You acknowledge that all content you upload is subject to review by Platform moderation staff before publication. Content is not published, and is not visible to any user, until that review is complete and the content is approved.
3.2 The Platform may reject, remove, or restrict any content at any time, with or without notice, at its sole discretion.
3.3 You will not attempt to circumvent, bypass, disable, or interfere with the pre-publication review process.
4.1 Before uploading any content, you must obtain and keep on record the written consent of every person depicted in that content. That written consent must specifically and separately address each of the following:
4.2 Consent must be given freely, knowingly, and in writing, by a person who is at least eighteen (18) years of age. Consent obtained through force, fraud, coercion, threat, intoxication, incapacity, or abuse of power is void and does not satisfy this Section.
4.3 Consent must be obtained before the content is uploaded. Retroactive consent does not satisfy this Section.
4.4 If any person depicted withdraws consent, you must notify the Platform in writing at info@onlydrain.com immediately, and the content will be removed.
4.5 You must retain these consent records for a minimum of seven (7) years following the last date the content appears on the Platform.
5.1 Before uploading any content, you must verify the identity and age of every person depicted in that content, and you must confirm that every person depicted is an adult of at least eighteen (18) years of age.
5.2 Verification must be performed using a valid, unexpired government-issued photo identification document showing the person's full legal name, photograph, and date of birth.
5.3 You must retain a legible copy of that identification document, together with the consent records required under Section 4, for a minimum of seven (7) years following the last date the content appears on the Platform.
5.4 You must be able to provide these supporting documents to the Platform upon request. You agree to produce them within three (3) business days of a written request from the Platform. Failure to produce them will result in immediate removal of the associated content, suspension of your account, and withholding of any pending payout.
5.5 Where content depicts any person other than yourself, you must disclose this at the time of upload and provide the identification and consent records for that person through the Platform's upload flow before the content will be reviewed.
5.6 You acknowledge that the Platform maintains records under 18 U.S.C. § 2257 and its implementing regulations, and that your compliance with this Section is necessary for the Platform to meet its obligations under that statute.
6.1 This Agreement applies in full to live streaming, real-time video, and one-to-one video sessions conducted through the Platform.
6.2 The consent and verification requirements in Sections 4 and 5 apply to every person appearing in live or real-time content. You may not permit any unverified person to appear.
6.3 You acknowledge that the Platform may monitor live and real-time sessions for compliance and may terminate any session at any time.
7.1 You retain ownership of your content. You grant the Platform a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, distribute, and make available your content on and through the Platform for the purpose of operating and promoting the Platform.
7.2 This license continues for as long as your content remains on the Platform, and for a reasonable period thereafter to the extent necessary to complete removal from backups and caches.
7.3 Users who have purchased content retain access to that content following your account's termination or the removal of your account, and this license survives to that extent.
You represent and warrant, for every item of content you provide, that:
9.1 You are an independent contractor. Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship between you and the Platform.
9.2 You are solely responsible for your own taxes, and for reporting income received through the Platform to the appropriate tax authorities.
You agree to indemnify, defend, and hold harmless the Platform, its owners, officers, and agents from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from or related to your content, your breach of this Agreement, your breach of any representation or warranty, or any claim by a person depicted in your content.
11.1 The Platform may suspend or terminate your account and remove your content at any time for any violation of this Agreement, with or without notice.
11.2 Where the Platform has reason to believe that content or conduct involves a minor, trafficking, exploitation, or non-consensual activity, the Platform will report to the appropriate authorities, including NCMEC and law enforcement, and will preserve and produce all associated records.
11.3 Pending payouts may be withheld during the investigation of any suspected violation.
11.4 You may terminate this Agreement at any time by ceasing to upload content and requesting account closure. Sections 4.5, 5.3, 7.3, 8, and 10 survive termination.
The Platform may update this Agreement. Material changes will be communicated to you, and continued use of the upload or streaming features after a change constitutes acceptance of the updated Agreement.
This Agreement is governed by the laws of the State of Florida, without regard to conflict of law principles.
